Contract Do’s And Don’ts
Having reviewed over 1450 contracts
as contract compliance consultant for
Legacy Group Keller Williams during
2008, I have notice a number of areas of
misuse or misunderstanding of the TREC
promulgated residential contract form. The
paragraph that was revised in June, 2008
and made mandatory for use by September
2008, paragraph 7D has two options (1) and
(2) and one of the two is required to be
checked.
If 7D (1) is checked which states that
the buyer accepts the property in its present
condition this is relating that the buyer does
not have any specific items to request to be
repaired by the seller as a condition for the
purchase.
This does not mean that the buyer
will not have an inspection completed and
it further does not mean that the buyer may
not come back to the seller after an inspection
has been completed and request, via an
amendment to the contract, that he/she
wants specific repairs.
If 7D (2) is checked the buyer is
indicating that there are some “specific”
repairs or treatments that the buyer has
noticed that the buyer wants repaired as a
condition of the purchase. Only specific
items or treatments should be entered in
this paragraph. There should be no general
statements like “any repairs that are found
to be needed by an inspector”.
Using 7D (2) does not preclude the
buyer from coming back to the seller during
the Option period of the contract and
requesting repairs using the amendment
form. If a listing agent tells the seller that
there will be no additional requests from
the buyer for repairs because there are
repairs listed in this paragraph, he is giving
the seller false expectations. Of course the
seller does not have to agree to additional
repairs but any things of major concern to
the buyer, that were not know at contract
and found out during the option period, will
always be items to be negotiated on and can
cause the entire transaction for terminate.
Having a good understanding of
these provisions can mean a smoother
transaction in the long run.

Preheat oven to 450 o
You will need:
CHICKEN VERDE
2 lbs of boneless skinless chicken breast
1
⁄2 cup sour cream
1
⁄2 cup of green salsa verde
(Herdez can be purchased at any HEB)
1
⁄2 cup monterey jack cheese grated
1
⁄4 cup chopped green onion
1
⁄4 tsp salt
1
⁄8 tsp ground pepper
Grill or brown chicken in a skillet
Place in 9x13 pyrex dish sprayed with non stick
Mix the rest of ingrediants and spread evenly
over the chicken
Bake 20 minutes at 450o until hot and bubbly.
Serve with a smile & enjoy!
